TERMS OF SERVICE: STORE CREATION & FUNDRAISING PROGRAM

Last Updated: July 2026

Provider: Fundraiser Swag (“Fundraiser Swag,” “Company,” “we,” “us,” or “our”)

Website: https://fundraiserswag.com

These Terms of Service govern your creation and operation of an online custom merchandise or spirit store, participation in optional fundraising programs, submission of content/artwork, and the collection and disbursement of fundraising commissions through Fundraiser Swag. By submitting a store creation request, uploading artwork, or using the Service, you agree to be bound by these terms.

1. STORE CREATION OPTIONS: MERCH-ONLY VS. FUNDRAISING

Organizations may choose between two store formats during registration or setup:

Option A: Merchandise-Only Store (No Fundraising / No Kickback)

Designed for schools, clubs, sports teams, and businesses that simply want an official, on-demand spirit wear and merchandise storefront without running a fundraiser.

  • Retail prices remain at baseline platform rates for supporters.
  • No commissions, kickbacks, or payouts are tracked, calculated, or disbursed.
  • No IRS Form W-9 or financial reporting is required from the organization.
  • Zero platform setup, hosting, or ongoing maintenance fees apply.

Option B: Fundraising Spirit Store (With Commission Kickback)

Designed for organizations seeking to generate revenue to support their programs, teams, or operations through product sales.

    • The organization elects to receive a fundraising 10% commission kickback on qualifying sales.
    • Governed by the commission rates, sales thresholds, review cycles, and W-9 tax documentation rules detailed in Sections 3, 4, and 5 below.

2. GENERAL STORE SETUP & AVAILABILITY

a) Zero Out-of-Pocket Expenses: Regardless of the store option selected (Merchandise-Only or Fundraising), custom online stores are created, hosted, and maintained with zero ($0.00) setup fees, platform hosting charges, or ongoing maintenance fees.

b) Year-Round Availability: Unless an agreed-upon limited promotional window is explicitly requested, online stores operate year-round, allowing supporters to make purchases on demand at any time.

3. COMMISSIONS, SALES THRESHOLDS & PAYMENTS (FUNDRAISING STORES ONLY)

The terms in this Section apply solely to organizations enrolled in Option B (Fundraising Spirit Store):

Commission Rate: Qualifying organizations earn a baseline fundraising commission of 10% of gross qualifying sales generated through their dedicated online store, unless otherwise agreed to in writing.

Exclusions from Commission:
i) Low-priced convenience and promotional items (including, but not limited to, stickers and decals) are excluded from the 10% commission calculation due to baseline production and material costs.

ii) Sales tax, shipping/freight charges, merchant processing fees, refunds, chargebacks, and returned orders do not constitute qualifying commissionable sales.

Sales Volume Requirement: To qualify for a commission disbursement, a fundraising store must achieve a cumulative gross sales threshold of at least $1,000.00.

Minimum Payable Commission: Disbursements are issued only when earned, payable commissions total $100.00 or greater.

Review Schedule & Payout Windows: Sales calculations and accounts are reconciled bi-annually (twice per year) based on two review cycles:

    • Cycle 1 (Summer/Fall): Sales tracked July 1 through December 31; accounts audited in early January; payouts issued between January 15 and January 31.
    • Cycle 2 (Winter/Spring): Sales tracked January 1 through June 30; accounts audited in early July; payouts issued between July 15 and July 31.

Payment Methods: Fundraiser Swag issues disbursements via mailed checks payable to the legal name of the organization, school, or authorized booster entity on file or electronic transfer via PayPal or Zelle to the legal entity.

Rate Adjustments: Fundraiser Swag reserves the right to modify commission percentages, platform reward structures, or retail pricing upon thirty (30) days’ written notice due to adjustments in operational, apparel blank, or manufacturing costs.

4. ADMINISTRATIVE FEES & COMMISSION EXPIRATION (FUNDRAISING STORES ONLY)

Administrative Allocation on Unmet Minimums: If a fundraising store does not meet the $1,000.00 cumulative sales threshold or the accrued commission balance remains under $100.00 at the scheduled reconciliation window, all accrued funds under $100.00 are retained by Fundraiser Swag to cover platform hosting, e-commerce management, and administrative overhead. Unmet balances under $100.00 will not roll over or be disbursed.

Account Inactivity / Dormancy: If an account is closed or terminated by either party with less than $100.00 in unpaid commissions, or if an account has unpaid funds remaining unclaimed for more than twelve (12) consecutive months due to missing or invalid payee details, all rights to those balances are waived, and the funds will be applied towards Fundraiser Swag administrative and operational costs.

5. TAX DOCUMENTATION & PASS-THROUGH REPORTING (W-9) (FUNDRAISING STORES ONLY)

Merchant of Record & Pass-Through Accounting: Fundraiser Swag operates as the merchant of record for all retail store transactions, collecting payments, remitting state sales taxes, and fulfilling goods. For fundraising stores, the 10% commission represents pass-through charitable/fundraising revenue owned by the participating organization.

Mandatory W-9 Submission: To ensure accurate IRS reporting and verify that distributed funds represent non-taxable, pass-through fundraising distributions, organizations enrolled in the fundraising program must submit a completed, signed IRS Form W-9 displaying their legal entity name and Employer Identification Number (EIN) prior to the release of any funds.

Payee Responsibility: Fundraiser Swag is not responsible for delayed, rejected, or withheld disbursements resulting from incomplete, incorrect, or omitted tax identification documentation. Each organization is solely responsible for determining its own tax-exempt status and filing requirements with federal, state, and local taxing authorities.

6. ARTWORK, LOGO SUBMISSION & INTELLECTUAL PROPERTY

Ownership & Warranty: You retain full ownership, copyright, and intellectual property rights to any logos, crests, mascots, illustrations, slogans, and designs (“Content”) you provide. By uploading or submitting Content to Fundraiser Swag, you represent and warrant that you hold all necessary legal rights, permissions, and trademark authority to use and license such Content.

Digitization & File Formats: High-resolution vector files submitted for standard print-on-demand products are prepared and digitized free of charge. In instances where complex artwork recreation or specialized embroidery digitizing is required without usable source files, setup or conversion fees will be quoted in advance.

Limited License to Fundraiser Swag: You grant Fundraiser Swag a non-exclusive, worldwide, royalty-free license to use, reproduce, modify for production (such as adjusting colors for garment compatibility or resizing for print beds), and display your Content across our platform, fulfillment networks, and marketing materials solely for producing, fulfilling, and promoting your store’s merchandise.

Content Accuracy & Indemnification: Fundraiser Swag reviews artwork files strictly for production printability and resolution quality; we do not review, correct, or verify spelling, grammar, dates, or graphical errors. You agree to indemnify, defend, and hold harmless Fundraiser Swag, its affiliates, and contractors against any third-party claims, trademark infringement allegations, copyright disputes, or legal liabilities arising from artwork or logos provided by your organization.

7. ORDER FULFILLMENT, SHIPPING & RETURN POLICIES

All end-user purchases through your custom store are governed by Fundraiser Swag’s customer service and manufacturing policies:

Custom Print-on-Demand Production: Products are made to order. Standard orders typically process and dispatch within 3–5 business days, with delivery within 4–6 business days post-shipment. Bulk orders require an average of 14 business days.

Return & Replacement Limitations: Because items are custom-decorated upon order, returns, refunds, or exchanges are not accepted for incorrect customer sizing, color selection, or buyer’s remorse.

Damaged or Defective Items: Customers must report transit damage, print errors, or manufacturing defects directly to info@fundraiserswag.com within 14 calendar days of delivery, accompanied by clear photo documentation. Approved claims receive a replacement or refund at no cost to your organization.

8. PROMOTION, MARKETING & SPAM RESTRICTION

While Fundraiser Swag reserves the right to showcase your store or branded products across marketing channels or social media, we are under no obligation to market your store. You agree that any independent marketing, digital promotion, or outreach conducted by your organization will comply with applicable laws and will not involve spam, misleading promotions, or unsolicited bulk messaging.

9. SUSPENSION & TERMINATION

Right of Termination: Fundraiser Swag may, in its sole discretion, suspend, restrict, or terminate your store or access to the Service at any time, with or without notice, if these Terms of Service are violated or if continued operation presents legal or reputational risk.

Voluntary Termination: You may request to close your store at any time upon thirty (30) days’ written notice.

Post-Termination Balances (Fundraising Stores): Upon store closure, any eligible, qualifying commissions meeting the $1,000.00 sales threshold and the $100.00 minimum payout balance will be disbursed during the subsequent standard payout window upon receipt of a valid W-9. Balances under $100.00 will be retained as an administrative fee. Merch-only stores have no payout rights or balances upon termination.
